Murray gave birth to a black child, although both she and the male donor were white. She did not post photos of him on social media and did not allow her friends and family to see the child. The woman also bought a home DNA testing kit. The test results showed that there was no biological relationship between her and the child. Murray then reported the error to the clinic.
When the child was three months old, custody of him was transferred to his biological parents. The BBC notes that Murray voluntarily gave up her parental rights after lawyers told her she had virtually no chance of winning custody in court. The child now lives with her biological parents in another state and under a different name.
"To carry a child, to give birth, to love on that child and to create a unique and special bond between a mother and child, only to have it taken away. I will never fully recover from that," Murray said.
The lawsuit Murray filed against Coastal Fertility Specialists says she is worried about her embryo. It is not known whether the doctors transferred her biomaterial to another couple by mistake and what may have happened to it subsequently.
"This was an isolated incident that did not affect other patients. On the same day that this error was discovered, we immediately carried out an in-depth review and introduced additional security measures to further protect patients and ensure that a similar incident does not happen again," the clinic said.
The BBC notes that in recent years, several lawsuits have been filed against fertility clinics in the US due to confusion in IVF procedures.
